By E. Phillip Groben, Esq. A primary purpose of the U.S. Bankruptcy Code is to provide a fresh start to the "honest but unfortunate debtor." The fresh start policy is manifested in two significant rights bestowed upon bankruptcy debtors: an automatic stay, which comes into existence upon the filing of a bankruptcy petition [11 U.S.C.§ 362 (a)] and the discharge injunction, which prevents creditors from collecting or pursuing debts that existed prior to the filing of the bankruptcy petition [11 U.S.C.§ 524]. However, the Bankruptcy Code balances these debtor rights with protections afforded to creditors. Key among these is the provision excepting certain tax obligations from discharge (National Association of Tax Professionals). |
