  • The IRS is sending redesigned notices twice this year to businesses, sole proprietors, etc. concerning information returns that have missing or incorrect TINs. The two redesigned notices are CP2100 and CP2100A.  You are most likely to receive the notices in response to a filed 1099-MISC or 1099-NEC.
  • The IRS backlog caused many employers to not receive ERC refunds in time to pay the additional FIT owed on the refunds. What the IRS says about the unpaid FIT. Taxpayers may be eligible for relief from penalties for unpaid or overdue FIT. The penalty will be waived if your company’s failure to pay the taxes had a reasonable cause and was not due to willful neglect. One reasonable cause is not receiving an ERC refund. Your company might qualify for the First Time Penalty Abatement program—if:  1. it had no penalties in the 3 prior years; or 2. it has not yet had to file a return (such as for a start-up); 3. it has filed all currently required returns or extensions, and 4.  it has paid or arranged to pay any taxes due (American Institute of Professional Bookkeepers.)

A primary purpose of the U.S. Bankruptcy Code is to provide a fresh start to the "honest but unfortunate debtor." The fresh start policy is manifested in two significant rights bestowed upon bankruptcy debtors: an automatic stay, which comes into existence upon the filing of a bankruptcy petition [11 U.S.C.
§ 362 (a)] and the discharge injunction, which prevents creditors from collecting or pursuing debts that existed prior to the filing of the bankruptcy petition [11 U.S.C.§  524].  However, the Bankruptcy Code balances these debtor rights with protections afforded to creditors.  Key among these is the provision excepting certain tax obligations from discharge
​(National Association
​of Tax Professionals).

Can Notaries certify COVID test results?

With all the at-home COVID tests being sent out, can Notaries Public watch someone take the test, including verifying the results and then certify the results? — M.S., Florida
No, this is not an authorized duty in Florida. It is possible, however, that the person could take the test, write an affidavit swearing that they passed the COVID test on that date, sign that affidavit in front of you, and have you perform a jurat on their affidavit.
